3.9 “DataBake” and “InfoSum” are unregistered trade marks of InfoSum Limited in the UK and internationally.
4. Paid-for datasets
4.1 You may download some smaller datasets from our site for free, but we reserve the right to charge a fee for certain larger datasets which are for non-consumer purposes only. Any fees payable will be clearly stated on our site, and will be payable in advance by you before the download starts. All prices quoted include VAT.
4.2 Credit card payments will be processed securely by our payment partner, Stripe, which will store your email address and payment details, and it makes these details available to us. We never see your full credit card details.
4.3 In the event that the download is interrupted or fails, you can contact us at firstname.lastname@example.org using the email address you entered on our website when making your payment and we can send you a new link for the download.
4.4 If your downloaded dataset is faulty or you are unable to download it, please let us know within 30 days and at our own discretion we will provide a replacement dataset or refund your original payment.
5. Links to Our Site
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. Any page linking to our site must not contain content which encourages or endorses any use of our site which would constitute a breach of any of our terms of service

To the extent permitted by law, and subject to the exceptions below, we hereby expressly exclude liability for all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity, any direct, indirect or consequential loss or damage incurred by you or any user in connection with our site or the dataset generation service, or in connection with the use, inability to use, or results of the use of our dataset generation service, any websites linked to it and any materials posted on it, including, without limitation any liability for:
loss of income or revenue;
loss of business;
loss of profits or contracts;
loss of anticipated savings;
loss of data;
loss of goodwill;
wasted management or office time; and
for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if reasonably foreseeable, provided that this condition shall not prevent claims for loss of, or damage to, your tangible property.
The provisions of this clause 7 do not limit or exclude our liability for death or personal injury arising from our negligence, nor our liability for fraud or fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law. Our liability under or in relation to our site or data generation service in respect of all claims (whether for negligence, breach of contract or otherwise) will be limited to the amount paid by you to us for data generation services.
8. Acceptable & Fair Usage Policy
8.1 Unless you have our express written permission, you are not permitted to:
sell or resell our datasets or any part thereof to third parties; or
use our datasets in the course of providing services to any third party, including but not limited to consultancy or technical services.

8.2 You may only use our site in a manner that is lawful. Specifically:
You must ensure that you comply fully with any and all local, national or international laws and/or regulations;
You must not use our site in any way, or for any purpose, that is unlawful or fraudulent;
You must not use our site to knowingly send, upload, or in any other way transmit data that contains any form of virus or other malware, or any other code designed to adversely affect computer hardware, software, or data of any kind; and
You must not use our site in any way, or for any purpose, that is intended to harm any person or persons in any way.
8.3 The use of the free dataset download service is subject to fair use. Excessive or abusive use of the free service is not permitted.
8.4 We reserve the right to suspend or terminate your access to our site if you materially breach the provisions of this clause 8 or any of the other provisions of these terms. Specifically, we may take one or more of the following actions:
Suspend, whether temporarily or permanently, your right to access our site;
Block you (e.g. via your IP address) from accessing the site temporarily or permanently;
Issue you with a written warning;
Take legal proceedings against you for reimbursement of any and all relevant costs on an indemnity basis resulting from your breach;
Take further legal action against you as appropriate;
